Recently, my divorce action was completed and finalized after nearly a year and half of personal hardship and much mental anguish. A partner of the firm expertly handled all aspects from the beginning when she was with another law firm and then after I moved over, with her to your firm. The uniquely bizarre aspects of the case that dealt more with personalities than martial property and non-existent assets, was handled with genuine concern for my son & I. Throughout the “troubled waters” I navigated through the tough times that dominated the entire process. For this I am grateful. She maintained the highest level of professionalism and candor during the process and the results were very favorable. There was no downside whatsoever. I thought you would like to know this. Our Frisco lawyers have years of experience handling all types of divorce
The law in Texas provides for several types of divorce, reflecting the diverse circumstances and needs of couples seeking to dissolve their marriage. Understanding the differences between these types can help individuals navigate the process more effectively. Here’s an in-depth look at the types of divorce available in Texas:
- No-fault divorce: Texas allows spouses to divorce without proving wrongdoing by citing “insupportability,” meaning the marriage is irreparably damaged due to conflict.
- Fault-based divorce: A spouse can seek a divorce based on misconduct, such as adultery, cruelty, abandonment, long-term incarceration, mental illness, or prolonged separation. Fault can impact asset division and spousal support.
- Adultery’s impact: While not required for divorce, adultery can influence court decisions on spousal support and asset division. Legal guidance can help navigate its effect on the case.
- Uncontested divorce: If both spouses agree on all major issues, the process is quicker, less expensive, and may not require a trial, though legal assistance can still be beneficial.
- Contested divorce: If spouses disagree on critical issues like property division or child custody, the divorce requires negotiation, mediation, or trial, making it more time-consuming and costly.
- Collaborative divorce: Both spouses and their attorneys work outside of court to resolve issues through negotiation, fostering a cooperative and private resolution.
- Mediated divorce: A neutral mediator helps spouses reach agreements on divorce-related issues, facilitating discussions without making final decisions. Mediation can be used in both contested and uncontested cases.
What are the financial implications of a divorce?
Understanding the financial implications of divorce is crucial. At Albin Oldner Law, our Frisco divorce attorneys guide you through the financial maze of divorce, helping you understand potential outcomes regarding asset division, spousal support, and long-term financial planning. Our goal is to protect your financial stability, ensuring you are well-prepared for life post-divorce.
Options for divorce proceedings in Frisco
Our Frisco divorce lawyers want our clients to achieve their goals throughout the divorce process in the least stressful, most cost-efficient manner possible.
Every situation is unique, and we often recommend the following.
- Negotiation: Your Frisco divorce lawyer negotiates directly with your spouse’s attorney to reach a resolution that aligns with your goals.
- Collaborative divorce: Both spouses hire separate lawyers committed to settling disputes without involving a mediator, judge, or jury, promoting cooperation.
- Divorce mediation: A neutral third party facilitates discussions, ensuring privacy and conflict resolution while your lawyer represents your interests.
- Trial: When necessary, your legal team will aggressively advocate for you in court, though litigation is often a last resort in family law cases.
How we can help with your Frisco, TX divorce
- Rights to marital home: Texas law aims for equitable division, but outcomes vary based on circumstances. Legal guidance helps protect your and your children’s interests.

- Post-divorce modifications: Changing circumstances may require adjustments to child support, custody, or spousal maintenance. Legal support ensures the decree evolves with your needs.
- Parental relocation: Moving with a child post-divorce involves legal complexities, especially regarding custody. Legal guidance ensures the move aligns with your child’s best interests.
- High-conflict divorce: A strategic approach balances assertive legal advocacy with emotional protection, minimizing stress and conflict for you and your children.
- Same-sex divorce: Unique challenges in custody and property division require knowledgeable advocacy to ensure rights are protected and respected.

Frequently asked questions about Texas divorce
How long your divorce will take to resolve depends primarily on whether you are filing a contested or uncontested divorce. If you and your spouse cannot agree on the terms of your divorce, the process will take much longer as your Frisco divorce attorneys negotiate the terms and the judge rules on your divorce settlement.
If you are going to file for divorce in Texas, you must have resided in Texas for a minimum of 6 months leading up to your divorce and have been living in the county in which you are filing for at least 90 days.
State law allows “nonresident” spouses to file for divorce in Texas as long as their spouse has lived in Texas for at least the last six months. |
In some Texas divorce cases, each spouse pays their divorce attorneys. In other divorce cases, one spouse must pay all or part of their ex’s attorney fees. The family law judge in Texas decides who pays divorce lawyer fees on a case-by-case basis.
In some situations, a judge may require you and your spouse to undergo mediation, especially if your divorce involves children. If the court does not require you to go through mediation, you may still want to consider it. Mediation allows both parties to discuss their disagreements about the divorce with an impartial third party (or mediator) who can then help them come to an amicable agreement and thereby spare both parties from having to undergo a lengthy court proceeding.
Privacy is a significant concern during divorce proceedings. Our team at Albin Oldner Law prioritizes your confidentiality, employing strategies to shield sensitive information and negotiations from public exposure. We understand the value of discretion and work to keep your personal matters as private as possible, providing peace of mind.
